H4 EAD USCIS Letter to Senate Committee, Other Letter Response April 2018

As you all know H4 Visa EAD removal regulation is on Fall 2017 Regulatory Agenda  and it is also on the lawsuit with SaveJobs USA pushing to remove the H4 EAD. In middle of all there is a lot of news around H4 EAD removal and coverage by news media. Of these, two are the major ones.

Senators Writing Letter to USCIS to re-consider the H4 EAD Removal – March 2018 :

Basically, a group of senators wrote a nice letter to USCIS explaining the importance of H4 EAD rule and how it plays a role in H1Bs life in US, how it is helping economy, etc. and asking USCIS to reconsider the removal of H4 EAD regulation.  USCIS has responded to the letter in a very simple way telling that they are doing all of the changes to USCIS work visa regulations to protect American workers and to be in line with Trump’s Buy American and Hire American Executive Order.  All the USCIS director says is that “Public will be a given a chance to submit the comments during the comment period of the regulation “. USCIS does not really talk about anything like they will consider the letter or anything…it is very much saying, we will hear the feedback and then decide… You can read the entire letter and response at : USCIS H4 EAD Letter Response to Senators 

USCIS Letter to Senate Updating all the H1B and H4 changes to Committee – April 2018 

Also, during April 2018, USCIS Director wrote to the Senate Committee on Judiciary updating all the changes they have done for H1B, L1 and H4 visa types to protect American Worked and make sure everything is aligned with the Buy American and Hire American EO by Trump.  In this summary update letter, USCIS says that their intention is to remove H4 EAD and the regulation for the same is in planning mode. It also tells the same as above letter indicating that they will review public feedback during the comment and notice period.  They do not talk about anything else like they will re-consider, etc.  Check original document of USCIS Letter sent to Senate Judiciary committee 

Overall, both of these responses from USCIS to H4 EAD rule removal does not look very positive for the current H4 EAD holders. If you are on H4 EAD, you should think of backup options as it can take time to plan….We still have a long way to go, but the news so far in 2018 has not been positive for current EAD holders of H4 visa.
